Application Process
1. Program overview
IBAFAF Cine Fund is a fiscal sponsorship program operated by Ibero-American Film Arts & Festival, Inc. ("IBAFAF"), a 501(c)(3) nonprofit organization incorporated in the State of Florida. The program allows approved independent film and media projects to solicit tax-deductible charitable contributions under IBAFAF's nonprofit status. Submitting an application does not guarantee acceptance into the program.
2. Eligibility
To be eligible for IBAFAF Cine Fund, a project must meet all of the following criteria: (a) the project must be a film, documentary, short film, web series, animated film, or other media work; (b) the project must reflect, represent, or serve Ibero-American stories, communities, cultures, or perspectives — including but not limited to those from Latin America, Spain, Portugal, and the Ibero-American diaspora in the United States; (c) the lead applicant must be a natural person aged 18 or older; (d) the project must not have been produced primarily for commercial advertising purposes; (e) the project must not promote hate speech, discrimination, or violence against any individual or group.
IBAFAF reserves the right to determine eligibility at its sole discretion.
3. Application and approval
Submitting an application constitutes the applicant's agreement to these Terms and Conditions. Applications are reviewed by the IBAFAF selection committee, which considers artistic merit, community impact, fundability, and alignment with the program's mission. Applicants will be notified of the committee's decision within 5 business days of submission. IBAFAF may request additional materials or a brief interview before making a final decision. Approval is valid for the project described in the application. Any material change to the project — including change of director, significant budget change, or change in subject matter — must be reported to IBAFAF in writing and may require a new review.
4. Fiscal sponsorship agreement
Upon approval, the applicant will receive and must execute a Fiscal Sponsorship Agreement before any fundraising activity may begin. The Agreement sets out the specific terms of the sponsorship, including the administrative fee, fundraising timeline, reporting obligations, and conditions for disbursement of funds. No funds will be disbursed prior to the execution of this Agreement.
5. Donations and fund management
All donations solicited under the IBAFAF Cine Fund program must be directed to IBAFAF and are the legal property of IBAFAF upon receipt. IBAFAF will maintain a designated project account for each sponsored project and will disburse funds to the project upon written request, subject to the terms of the Fiscal Sponsorship Agreement and verification that expenses are consistent with the approved project budget. Funds may only be used for purposes directly related to the production, completion, or distribution of the approved project. IBAFAF will issue IRS-compliant tax receipts to all donors on behalf of the sponsored project. Applicants may not represent that donations to their project are tax-deductible unless they have an active, executed Fiscal Sponsorship Agreement with IBAFAF.
6. Reporting obligations
Sponsored projects are required to submit a written progress report to IBAFAF every 90 days while the project has an active fundraising campaign. Reports must include a summary of production progress, a brief financial update, and any material changes to the project. Failure to submit required reports may result in suspension of disbursements or termination of the sponsorship agreement.
7. Credit and acknowledgment
All sponsored projects must include the following credit in the completed project and in all fundraising materials: "[Project Title] is a fiscally sponsored project of Ibero-American Film Arts & Festival (IBAFAF), a 501(c)(3) nonprofit organization." IBAFAF may feature the project and the applicant's name, biography, and project materials on its website, social media, and marketing materials for the purpose of promoting the IBAFAF Cine Fund program. Applicants grant IBAFAF a non-exclusive, royalty-free license to use project stills, clips (up to 3 minutes), and written materials for this purpose.
8. Intellectual property
IBAFAF's role as fiscal sponsor does not grant IBAFAF any ownership rights over the project or its intellectual property. The applicant retains full creative and intellectual property rights over the project at all times, subject to the credit obligations described in Section 9.
9. Termination
Either party may terminate the fiscal sponsorship relationship with 30 days written notice. Upon termination, any unspent funds held by IBAFAF will be returned to the project after deduction of any outstanding administrative fees and any unreimbursed expenses incurred by IBAFAF on behalf of the project. If IBAFAF determines that a project is no longer eligible, has materially changed without notice, or has violated these Terms and Conditions, IBAFAF may terminate the sponsorship immediately and without notice, and will determine the disposition of any remaining funds in accordance with IRS guidelines for charitable funds.
10. Limitation of liability
IBAFAF is not responsible for the creative, editorial, or commercial outcome of any sponsored project. IBAFAF's total liability to any applicant or sponsored project under these Terms and Conditions shall not exceed the total amount of funds disbursed to that project in the 12 months preceding the claim. IBAFAF shall not be liable for any indirect, incidental, or consequential damages arising from the program.
11. Governing law
These Terms and Conditions are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
12. Amendments
IBAFAF reserves the right to amend these Terms and Conditions at any time. Applicants and sponsored projects will be notified of material changes by email. Continued participation in the program after notice of changes constitutes acceptance of the revised terms.
13. Process
The selection process takes place in two stages.
Stage 1 – Project Inquiry
Filmmakers submit an initial inquiry form describing their project, creative vision, and team.
A $30 USD application fee will be charged upon submission.
The estimated review period is approximately 1–2 weeks.
Stage 2 – Full Application
Projects that meet the initial criteria will be invited to submit a full application including materials such as:
· Project deck or pitch materials
· Script or treatment
· Budget and financing strategy
· Creative team information
Selected projects will then enter into a formal Fiscal Sponsorship Agreement with IBAFAF.
